Position Overview
We are seeking a skilled Real Estate / Housing Attorney to provide comprehensive legal counsel and representation in transactional and litigation matters involving residential and commercial real estate and housing law. The successful candidate will manage a diverse caseload that includes lease drafting and disputes, unlawful detainer actions, quiet title and boundary easement matters, title insurance issues, foreclosures, and premises liability claims. This role requires courtroom experience, strong negotiation and drafting skills, and the ability to advise clients on risk and regulatory compliance.
Key Responsibilities
- Manage a full caseload of real estate and housing matters, including litigation and transactional work, from intake through resolution.
- Prepare, review, and negotiate leases, purchase and sale agreements, easement instruments, boundary agreements, and other real estate contracts and closing documents.
- Represent clients in state and federal court and administrative hearings for unlawful detainer (eviction) proceedings, quiet title actions, foreclosure defense and enforcement, and premises liability claims.
- Draft pleadings, motions, discovery requests and responses, settlement agreements, and other litigation documents; conduct legal research and prepare legal memoranda and trial briefs.
- Work with title companies, surveyors, brokers, lenders, and opposing counsel to resolve title issues, secure title insurance endorsements, clear clouds on title, and resolve boundary/easement disputes.
- Advise clients on regulatory compliance, landlord-tenant law, habitability issues, risk management, and enforcement options; counsel clients on eviction and rent collection strategies consistent with applicable statutes and ordinances.
- Negotiate settlements, orchestrate alternative dispute resolution, and pursue favorable resolutions while protecting client interests and minimizing exposure.
- Appear in court, mediations, and other proceedings; prepare witnesses and exhibits; handle trial and evidentiary hearing preparation as needed.
- Maintain clear client communications, timely case updates, accurate timekeeping, and billing records; supervise or mentor junior attorneys and paralegals as appropriate.
- Stay current on developments in real estate and housing law, and contribute to firm knowledge-sharing and practice development efforts.
Qualifications
- Juris Doctor (JD) from an accredited law school and active membership in the state bar where the attorney will practice.
- Admission to practice before relevant state and federal courts is preferred.
- 3+ years of experience practicing real estate and/or housing law with demonstrable litigation experience (unlawful detainer/eviction, quiet title, foreclosure, premises liability).
- Proven experience with drafting and negotiating leases, purchase agreements, easement and boundary documents, and title-related instruments.
- Practical knowledge of title insurance practices and experience resolving title defects and obtaining endorsements.
- Strong courtroom experience: motion practice, discovery, hearings, trial preparation, and client representation at mediations and trials.
- Excellent legal research, writing, drafting, negotiation, and advocacy skills.
- Familiarity with landlord-tenant law, rent and eviction procedures, habitability (habilability) issues, and local housing code enforcement.
- Ability to manage a high-volume caseload, prioritize deadlines, and deliver high-quality work under pressure.
- Strong interpersonal skills, client-focused orientation, and the ability to coordinate with multidisciplinary teams (brokers, lenders, surveyors).
- Proficiency with case management, document management, and billing software; commitment to ethical practice and professional responsibility.
