Pre-Litigation Attorney
Position Overview
We are seeking a detail-oriented Pre-Litigation Attorney to manage investigations, client intake, claim evaluation, and demand preparation for personal injury and related matters. The ideal candidate will work to resolve disputes efficiently through strategic negotiation and thorough pre-filing preparation, minimizing time and cost while maximizing client recovery.
Key Responsibilities
- Manage client intake and conduct comprehensive factual and legal investigations for potential personal injury claims.
- Analyze liability, damages, and policy issues to assess case value and litigation exposure.
- Draft and prepare demand letters, pre-suit correspondence, and settlement proposals tailored to case strategy.
- Negotiate with insurers, defense counsel, and other parties to achieve favorable pre-litigation resolutions.
- Coordinate with medical providers, vocational experts, and other vendors to obtain and organize evidence and documentation.
- Prepare and review pre-suit pleadings, preservation letters, and file reports; recommend next steps including litigation if settlement cannot be reached.

Counsel clients on claims, expectations, timelines, and potential outcomes while maintaining regular and clear communication.
Qualifications
- Juris Doctor (JD) from an accredited law school and active bar membership in the hiring jurisdiction.
- 2+ years of experience practicing law with a focus on personal injury, insurance claims, or other civil litigation pre-suit work.
- Proven experience drafting demand letters, settlement proposals, and pre-suit legal correspondence.
- Strong negotiation skills with a track record of resolving claims before filing suit.
- Excellent legal research, writing, and analytical abilities; attention to detail in document preparation and case analysis.
- Ability to manage a caseload, prioritize tasks, and meet deadlines in a fast-paced environment.
- Professional communication and client counseling skills; experience collaborating with experts and handling medical records and billing.
- Familiarity with applicable statutes of limitations, insurance coverage issues, and court filing requirements.
