Position Overview
We are seeking a detail-oriented Pre-Litigation Attorney to join our personal injury practice. The successful candidate will evaluate incoming claims, prepare demand letters, lead settlement negotiation efforts, and manage the pre-suit phase of personal injury matters to achieve favorable resolutions for clients while minimizing litigation. This role requires strong analytical skills, excellent written advocacy, and the ability to develop strategic case positions to maximize client recovery prior to filing suit.
Key Responsibilities
- Conduct thorough pre-litigation assessment of personal injury claims, including review of medical records, liability evidence, and damages.
- Draft clear, persuasive demand letters and settlement packages tailored to the facts and legal theories of each claim.
- Communicate with clients to gather facts, explain case strategy, manage expectations, and provide timely status updates.
- Negotiate with defense counsel and insurance adjusters to obtain fair settlements, using documented valuation and negotiation strategies.
- Prepare and manage pre-suit discovery and evidence preservation steps, including requests for records, witness statements, and expert retention as needed.
- Collaborate with litigators and support staff to transition cases to suit when settlement is not achievable, ensuring complete and organized case files.
- Maintain accurate case files, calendar critical deadlines, and ensure compliance with ethical and procedural requirements.
- Analyze trends in claim outcomes and adjust pre-litigation strategies to improve settlement rates and client satisfaction.
Qualifications
- Juris Doctor (J.D.) from an accredited law school and active bar license in the hiring jurisdiction.
- 1+ years of experience handling personal injury matters, with a focus on pre-litigation claim evaluation and settlement.
- Demonstrated skill drafting demand letters and settlement proposals that produce results.
- Proven negotiation experience with insurance carriers and defense counsel, showing measurable settlement success.
- Strong legal research and analytical abilities, with attention to detail in evaluating liability and damages.
- Excellent written and oral communication skills; client-facing experience preferred.
- Ability to manage a high-volume caseload, prioritize tasks, and meet deadlines in a fast-paced environment.
- Familiarity with medical terminology and records review or experience working with medical experts.
- Commitment to ethical practice, client advocacy, and teamwork.
